Bill Would Rein in Trump’s Use of the Military and Tariff Powers

ATLANTA, GA, March 24, 2026 /24-7PressRelease/ — Allen Buckley, a fiscal conservative and the Libertarian Party of Georgia’s U.S. Senate candidate in 2004, 2008, 2016, and 2026, has drafted legislation designed to rein in the powers of the Executive Branch, including tooth-filled impeachment powers potentially applicable to a president who violates the War Powers Resolution.

The Balance of Powers Restoration Act (BOPRA), drafted by Buckley, would reduce the power of agencies beyond the reduction caused by the Supreme Court’s Loper Bright decision of 2025 by making things done by agencies without statutory authority void (without going to court), eliminate tariffing powers of the president (thus returning those powers to Congress), create a process involving Congress that must be followed before the military can be used with potential impeachment for failure to do so, and require Congress establish a rainy day fund for government shutdowns such as the current TSA shutdown, while preventing Congress from being paid during any shutdown.

BOPRA aside, Buckley’s campaign includes many pieces of legislation drafted by Buckley, including reforms to major entitlement programs that will drive down spending and reduce healthcare costs, and immigration reforms including a solution as to those here illegally.

Buckley said: “We can’t let the president take us to war. If enacted, the Balance of Powers Restoration Act would go a long way to getting our nation back in line with the Constitution, in terms of relative powers of the Executive Branch vis-à-vis Congress and the people. It’s hard to understand why the major parties cannot put something like it together.”

The Georgia U.S. Senate race is expected to be tight. Presently, the Libertarian Party of Georgia lacks ballot access, having lost it in 2024. It is in the process of attempting to reacquire it.
